Fanminder (which we’ll refer to as the “Company”, “us”, “our”, or “we”) provides an internet-based application, marketing website and related services (the “Service”) for publishing and receiving information between the Service and your customers’ cellphones.

This Privacy Policy describes the types of personal and non-personal information we collect when you use the Service, how we use such information and to whom and under what circumstances we may disclose it. Fanminder takes its obligations regarding privacy very seriously, and it wants to ensure you are fully informed about the Information you are providing us. If you do not agree to these terms, please do not use the Service.

Times change. And so, we may change this Privacy Policy at any time. When we do, we’ll try to notify you but can’t promise that. If we add new terms or policies they will automatically become subject to this agreement. We also put a date stamp at the top of the page representing the last day it was updated. If we change the Privacy Policy and you’re still using us after the last dated change, you’re telling us that you agree to those changes. If there’s something in it that you don’t like, call us. We may or may not be able to do anything about it, but we will respect you and listen to you.

Throughout this Privacy Policy, we’ll refer to a registered user of the Service as “User.” That’s you. Your customer who opts in to receive and send text messages with you utilizing the Service will be referred to as a “Fan.”

Collection of information

The following types of Information about a User and a Fan are among those that may be collected by Fanminder to operate the Service:

• Name
• Postal address
• E-mail address
• Business Telephone (including Toll-Free) number
• Fax Number
• Mobile phone number
• IP Address, and other technical information collected by the Service’s server.
• Referring site

Fanminder may collect additional information in its discretion, to operate the service.

How Fanminder collects information

Fanminder may collect information in the following ways:

• Through forms filled out by a User on the website of the Service or via websites operated by Users.
• Through SMS (Short Message Service) messages sent via the Fan’s cell phone to short codes provided by Users.
• Through information provided by Fanminder or a User in connection with surveys and prize promotion entries
• Through Information provided by Users about Fans
• Through the maintenance and analysis of Web server logs
• Via SMS, e-mail and other communications between a User and a Fan

To improve your experience with our Service, we may also collect non-personally identifiable information from you via “cookies” (small text files placed by Fanminder on a User’s computer(s)), single-pixel GIF image files (also called “Web beacons”), Web server log analysis and other similar technological means. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information. However, once you become a User and furnish the Service with personally identifiable information, this information may be linked to the data stored in the cookie.

We may advertise the Service on the Internet using a third party vendor. These vendors may utilize cookies or other technological means within the advertising to collect and utilize non-personally identifiable information. Fanminder is not responsible for information collected by third parties in this manner, nor for the collection or use of information by other sites to which the Service is linked. Fanminder does not have any control over information that is submitted to, or collected by, these third parties and won’t be responsible for the content of these third party sites.

No Collection of Information from Children

The Site is not intended for Users under the age of 18, nor does Fanminder knowingly collect or retain information in connection with the Site from children under the age of 13.

Use of Information

Fanminder may use information collected to operate the Service in the following ways:

• To provide requested information, products and services to Fans of Users
• To enable Users and/or Fans to enter promotions and receive prizes from Fanminder and/or third parties
• To improve the user experience with the Service
• To operate the Service
• For Users to obtain information and offers for products and services offered by Fanminder as well as selected third parties.

Information Sharing

Fanminder may share aggregate, non-personal information with third parties. Fanminder may share your personal information with other parties in the following circumstances:

• When we have your consent.
• To our vendors if the disclosure will enable them to perform a business, professional or technical support function for us. These companies work with us under confidentiality agreements and are prohibited from making any other use or disclosure of your personal information.
• If we determine that there has been a violation of Service policies.
• If we have reason to believe that such disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference (either intentionally or unintentionally) with our rights or property, other Users of the Service or anyone else that could be harmed by such activities.
• To respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law.
• To provide, sell, or transfer information to a company that acquires, is acquired by or is merged with Fanminder.

Wireless Policy

Fanminder and our vendors may use information to provide the services requested by a Fan, including utilizing a provided cell phone number for voice communication with the Fan and services that display customized content and advertising via SMS messages sent to such provided cell phone number. In addition to any fee of which a Fan is notified, the Fan’s provider’s standard messaging rates apply to confirmation and all subsequent SMS correspondence. All standard messaging charges are billed by and payable to the Fan’s mobile service provider. Neither Fanminder nor its vendors will be liable for any delays or errors in the delivery of any SMS messages, as delivery is subject to effective transmission from the user’s network operator. SMS message services are provided on an AS IS basis.

Data Security

The importance of security for all personally-identifiable information associated with Users of the Service is our utmost concern, and we have implemented, and periodically review, certain physical, electronic, and managerial procedures to help prevent unauthorized access and maintain data security. Unfortunately, due to the open nature of Internet communications, no data transmission over the Internet can be guaranteed to be secure, and thus we cannot guarantee that communications between you and Fanminder will be free from unauthorized access by third parties. So Users of the Service use the Service at their own risk.

Opting out from offers from Fanminder

At any time, a Fan may discontinue receiving SMS offers from you by sending the SMS message STOP, STOP ALL, QUIT, END, CANCEL, UNSUBSCRIBE, and STOP DEACTIVATE to the applicable shortcode or by following other instructions provided by you.

Access to information

All Users who provide their information to Fanminder may modify and correct such information on the Service website or by e-mailing us at help@fanminder.com.

Your California privacy rights

Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Fanminder who are California residents to request certain information regarding Fanminder’s disclosure of personal information to third parties for such third parties’ direct marketing purposes.
